Son Withdraws Eviction Lawsuit Against 98-Year-Old Mom [Update]

Peter Kantorowski, 71, of Trumbull withdrew the lawsuit a day before going to trial against his mother, a longtime Fairfield resident, his lawyer told The Associated Press.

The Trumbull man who said he was trying to help his 98-year-old mother by attempting to evict her from her Fairfield home has withdrawn the lawsuit, according to an Associated Press report published on NBC Connecticut's website.

The trial between Peter Kantorowski, 71, and his mother Mary Kantorowski was scheduled to begin in Bridgeport Superior Court on Friday.

Mary Kantorowski's lawyer told the Associated Press that Kantorowski is capable of taking care of herself.

A Trumbull man’s unusual legal battle to evict his 98-year-old mother from her home has thrust the family into the media spotlight.

Peter Kantorowski, 71, says he’s only trying to help his elderly but able-bodied mother, who lives alone, by evicting her. He says he wants to get her into a nursing home, or have her come live with him, because he's concerned about the quality of her care. Problem is his mother, Mary Kantorowski, is refusing to leave the small yellow cape she's been in since 1953.

According to an Associated Press report, Peter Kantorowski became the owner of the home several years ago when his mother transferred the deed to him, but retained the right to live there through a quit claim. He reportedly served his mother with an eviction notice in December, shortly before her 98th birthday, after several failed attempts to persuade her to move out.

Mary Kantorowski, however, says she won't leave the house her late husband wanted her to stay in until she died, according to the report.

The case will head to trial on March 2 in Bridgeport Superior Court.
