U.S. Supreme Court Upholds Obama Healthcare Plan

The justices also found that the so-called "individual mandate" in what's become known as Obamacare, is constitutional.

In a landmark decision, both legally and politically, the U.S. Supreme Court has upheld President Barack Obama's sweeping healthcare law, including the central mandate that individuals must buy health insurance.

Pundits and politicians alike are already heralding the decision as a major political boon to Obama, whose supporters were concerned that an overturn of the law, or just the individual mandate, would harm the president's re-election bid this year.

Obama's health care law, which also requires health insurers to provide coverage to children of policy holders up to 26 years old and bans insurance companies from denying coverage for pre-existing conditions, was challenged by several states who argued that some of its conditions, particularly the individual mandate, were unconstitutional.

Republicans also had vehemently opposed the health care law and their presumptive presidential nominee, Mitt Romney, has vowed to seek its repeal if he's elected.

SCOTUS' ruling is shocking, especially that Roberts joined the 4 liberals to uphold this legislation that was passed in such a dastardly fashion. Two other ironies are that: 1) Obama as a senator voted against confirming Roberts to the SCOTUS, and yet here he has been the one to seemingly go against all expectations and 'save Obama's bacon'! 2) That the mandate was "upheld" by the court NOT under the Commerce Clause, but under the notion that congress does have the power to TAX Americans if they don't purchase something, and the PENALTY for not purchasing insurance is ruled to be a "TAX." Obama had repeatedly declared that the penalties under Obamacare for not buying insurance are "not a tax." The "poll" that matters most will be in November, and this overwhelmingly unpopular result today (some 60% of Americans hate Obamacare) will help Romney get elected!

Actually, the penalty or "tax" is exactly the same as what the Massachusetts plan provides for that was developed by Mitt Romney. There is 98% coverage in Mass and the population approves the plan 90%. Any criticism that Romney throws at the Affordable Health Care Act is total hypocrisy. He also said he never raised taxes, so if Romney states that Obama is raising taxes, Romney must admit that he did as well. Since the 1920's any legislation regarding the taxing power of Congress has withstood any challenge. I am proud that Roberts decided purely on legal grounds and didn't let partisan issues get in the way. That gives me hope for the Court. The Court should only be looking at what is Constitutional as Roberts stated. Once people understand that this law is Constitutional, will provide coverage for more people and ultimately lower health care costs, which is exactly what happened in Massachusetts, there will be growing acceptance. Actually the latest polls show a 51% approval of the plan, and the Supreme Court ruling will only serve to increase the approval rating.
